HIMOINSA Generator Warranty – Terms and Liability
As APEX POWER GENERATORS - We are responsible for the warranty of HIMOINSA generator sets only within the territory of Poland.
HIMOINSA, as a global manufacturer, provides international warranties, for which selected dealers in a given country are responsible.
When exporting a HIMOINSA generator set abroad, we have no influence on how your warranty will be handled - you may lose it, be aware of this.
Warranty period and warranty rules applicable within the territory of Poland:
Generator sets for continuous operation - 24 months from warranty activation with a limit of up to 4000 engine hours of operation.
A generator set for continuous operation is a machine that annually must operate for at least 2000 engine hours.If it operates less than 2000 engine hours per year - such a machine will be treated as a standby (emergency) unit.
If it operates with a load of less than 25% of rated power - such a machine will be treated as a standby (emergency) unit.
Generator sets for standby (emergency) operation - 24 months, or 1000 engine hours depending on what occurs first.
In both situations, it should be remembered that the minimum
operating load of the generator set is 25% of its rated power.
Faults and failures
caused by operation due to underloading the generator set (operation below 25 %
of the rated power of the generator set) are not covered by the warranty.
The average operating load of the machine is checked by dividing the number
(amount) of produced kWh by the time during which the generator set operated.
By dividing the total produced power by the total engine hours we will obtain the average power at which the generator set operated.
In each generator set, the parameter of produced kWh and the operating time of the generator set is recorded.
For example:
A machine with rated power 500 kVA = 400 kW
Minimum operating load 25% of 500 kVA = 125 kVA = 100
kW
So, to ensure trouble-free and correct operation of a generator set with power 500 kVA - it should operate with a continuous load of at least 125 kVA = 100 kW
Operating an underloaded generator set, below 25-30%
of its rated power will result in faster wear of the machine and
more frequent failures.
The key issue for the warranty
to start and be considered is completing the warranty registration form within 10
days from product start-up or one month from the date of purchase.
It is recommended
that the first start-up of the product be carried out with the consent of or in
the presence of an authorized HIMOINSA service, or the HIMOINSA Polska
Sp. z o.o. service.
APEX Power Generators is an authorized
HIMOINSA Polska service and may perform activities related to
starting the generator set and activating the warranty.

COMPANY RESPONSIBILITY:
In
countries where HIMOINSA has a network of authorized service centers
(see information at www.himoinsa.com), the warranty consists of
replacing or repairing damaged parts after it is determined that
the damage results from a factory defective material, workmanship or
assembly. The warranty covers both the cost of replaced parts and
labor during normal working hours. The customer bears the cost of transport
to the authorized distributor’s facility where the
repair will be carried out.
The warranty in the remaining countries of the world consists of free delivery, at the plant in San Javier (Murcia, Spain), of parts that must be replaced due to manufacturing defects, workmanship or assembly. If the unit is sent to the manufacturer’s plant, all required repair work is performed free of charge.
In such a case, transport costs, both ways, are covered by the customer.
The warranty is effective only after prior technical inspection of the defective parts. For parts sent or repairs performed before confirmation of the defect, invoices will be issued. All replaced parts must be returned to Himoinsa, to which they become the property.
In the event of an engine or alternator defect, HIMOINSA informs that assistance provided under the warranty is rendered by the authorized technical services of the engine or alternator manufacturer, who determines the scope of the warranty.
The defect must appear during normal use of the product within the warranty period. The company will deliver the spare parts needed for replacement as soon as possible; however, it is not responsible for any losses resulting from the inability to use the unit in the meantime.
All warranty claims should be submitted to the authorized seller or distributor in the relevant area, who will handle the claim and determine the scope of the warranty.
The warranty
does not cover failures or defects resulting from normal use or
wear, improper use (including overloading or
overvoltage), negligence, accident, introduction of unauthorized
modifications.
Lack of maintenance or improper maintenance or
improper connection (improper storage, transport or
installation).
Any use of the unit beyond its capabilities and
limits specified by the manufacturer or in circumstances other than
recommended.
Failures resulting from other failures that should have
been detected.
Damage to batteries, lamps and fuses.
Damage resulting
from the use of parts not supplied or manufactured by the
manufacturer.
The warranty also does not cover the cost of renting
replacement equipment during repair time, nor the cost of connecting the product to other
customer equipment.
Parts that have been repaired or replaced are covered by a six-month (6) warranty, without affecting the warranty covering the remaining elements.
Devices or components not manufactured by the company. The company offers the same warranty as provided by the supplier, with the same liability limitations as those provided in the warranty for devices manufactured by the company.
All complaints concerning the fuel injection system and its components are forwarded by HIMOINSA to the injection system manufacturer or its authorized representative. The report of the manufacturer or its authorized representative REGARDING THE FAILURE is binding for both parties: i.e. Himoinsa and the buyer.
USER RESPONSIBILITY:
The user is responsible for:
Installing and using the product in accordance with the operating instructions and other documentation supplied with it, if necessary with the help of qualified technical personnel, in accordance with applicable standards and regulations.
Carrying out proper maintenance of the unit and using the appropriate fuel, oil, antifreeze and lubricants, as well as replacing any parts and components needed for normal operation of the unit.
Sending back
the properly completed warranty registration form within 10
days from product start-up or one month from the date of purchase,
depending on which of these deadlines expires first.
Notifying the company or the authorized service in the country in writing of any defects in material, along with an explanation, within seven days of the defect occurring, before the warranty expires. Otherwise, the buyer loses warranty rights.
If repairing the defect requires the participation of other equipment not manufactured by HIMOINSA, all costs related to this - including labor - are borne by the buyer. The buyer also has the obligation to ensure full access to products manufactured by HIMOINSA S.L.
Accepting the technical report on the presence or absence of defects in the material or assembly.
Labor costs , except as mentioned in the section “COMPANY RESPONSIBILITY”, including those related to installation and dismantling of the unit.
Costs and risk related to transport or shipment of the unit and any other costs related to replacement of components.
Any other costs, including transport and carriage, accommodation, taxes and fees, communication costs and overtime, except for those mentioned in the section “Company responsibility”.
Payment of the total price of the machine, spare parts and services related to the product during the warranty period.
Any assistance of technical or sales personnel in demonstrating start-up or operation of the unit does not mean that this warranty covers installation or assembly.
Servicing is expressly excluded from the scope of this warranty.
THE WARRANTY BECOMES VOID IN THE FOLLOWING CASES:
If the documentation (warranty, purchase invoice, operating and maintenance instructions) has been modified in any way or is illegible.
If the serial number and model have been changed, erased or removed, or are illegible.
HIMOINSA is not contractually or non-contractually liable for any material or immaterial damages, direct or indirect, whether or not resulting from material damages covered by this warranty, such as operating losses, expenses and costs resulting from the inability to use the product, nor for damages to third parties or damage to other installations or products.
This warranty does not limit any rights of the buyer as a consumer, held by him in accordance with applicable law. This warranty replaces all other warranties, express or implied, including, but not limited to, warranties of merchantability or fitness of the unit for a particular purpose. Claims not covered in the above provisions will not be considered by the company.
HIMOINSA informs the user of the obligation to follow the operating and maintenance instructions and to retain the remaining documents technical documents attached to the unit, in accordance with standards and occupational safety and health regulations. It is also recommended to install special protections against overvoltage and overload of the main electrical circuit, as well as other protections, in consultation with an authorized installer.
